Construction Accidents
I am experienced in representing construction workers that have been injured falling from scaffolds, roof tops, decks, and ladders, or who have been struck with hoisted construction materials. I have also represented workers that were personally injured from slips, trips and falls on construction work sites. I was able to help these workers because the New York State Labor Law sections 240 and 241 requires that workers on construction sites are to be provided adequate and proper protection while in the performance of their job duties.
Labor Law Section 240 further provides that owners and general contractors provide appropriate ladders, scaffolding, and/or other types of fall protection for workers performing duties at elevated heights, or when workers are exposed to the dangers of materials being hoisted, connected, or secured. Workers that are personally injured as a result of a violation of the statute may be entitled to compensation for pain and suffering and additional benefits beyond those required to be provided under the New York State Worker’s Compensation Law. Fractured wrists, fractured heels (calcaneus) and ankles, herniated discs, rotator cuff and torn ligaments in the knee are the types of injuries that my former clients have suffered when the property owner of general contractor has violated the statute.
I have occasionally received calls where the person is injured on State or local government property. These types of cases require immediate attention as they involve a Notice of Claim or Notice of Intention to File a Claim. The time limitations to file a claim or lawsuit are usually extremely short.
